MOSER SCHAFFHAUSEN AG respects your right to privacy in the online world when you use our Sites, when you visit our Pioneer Chronicles and when you use the H. Moser and Cie App. This Privacy Notice explains how and for what purposes we use the information collected about you through our Sites and App, via offline programs or events.

Scope of this Privacy Notice and your consent

By using our Sites and App or by giving us your personal data, you accept the practices described in this Privacy Notice. If you do not agree to this Privacy Notice, please refrain from using or visiting our Sites and App or providing personal data. 
MOSER SCHAFFHAUSEN AG reserves the right to make any changes and corrections to this Privacy Notice. Please refer to this page from time to time to review these and any new additional information.

What personal data we collect about you?

We only collect personal information that is necessary for a specific purpose or that you provide us with your consent, based on your actions and behaviours or for a legitimate reason:

  • Personal contact information such as gender, age, name, full address and email, telephone number or geographic location;
  • Information related to your orders and purchases placed on our website via our Concierge Services or through our authorized retailers, such as watch purchased and shipping address; 
  • Information about your watch, such as serial number, date and place of purchase;
  • Information about your non-fungible-token linked to a specific and limited watch edition, such as serial number, date of activation and type of digital art;
  • Payment information, such as credit cards, and billing addresses; 
  • Your comments and user-generated content, including any photos, videos and personal stories that you share with us;
  • Your profiles on social networks; 
  • Your preferences regarding our products.

We collect this information directly from you.
We also use cookies and other tracking technology which collect certain kinds of information when you interact with our Sites and App or open our emails, such as IP addresses, devices or browsing preferences. You can find more information in our Cookie Notice.

We may collect personal data about you from third party data aggregators (e.g. Google), promotional partners, public sources and third-party social networking sites. Such information may include personal data as part of your profile on a third party social network and that you allow that third party to share with us, pursuant to their rules.

Why do we collect personal data and use it?

We may collect and use your personal data for a number of purposes and on the following legal bases:

Contractual basis:

  • to fulfil your orders and purchases, including after sales service;
  • to respond to your queries or share them with our partners so that they respond to you in your language or in relation to your country of residence;
  • to respond to job offers or job enquiries;

Based on your consent:

  • to contact you for marketing purposes and/or send you our Newsletter;
  • to provide the best user experience possible on our Sites;

Based on our legitimate interest:

  • to perform Know Your Customer verifications to prevent fraud and other prohibited or illegal activities, in line with applicable regulations and laws;
  • to let you know about different but related offerings to your purchases that may be of benefit to you;
  • for security and maintenance of our Sites and App and our physical stores;

Based on our legal obligations:

  • for reporting purposes as well as risk, dispute, and/or record management to comply with our legal and financial obligations or to aid in dispute resolution.

With whom do we share personal data and are the data transferred abroad?

We may disclose your personal data to the following internal and external recipients:

  • our partners, official retailers and our after-sales service centre; 
  • our service providers who assist us operating our business (e.g: payment provider, Know Your Customer provider, logistic providers, marketing agencies, providers used to create, issue and certify non-fungible-token, etc);
  • authorities if so requested by law.

In addition, the MOSER SCHAFFHAUSEN AG Sites and App may use third parties such as network advertisers and ad exchanges to serve you ads on third party websites after you leave our MOSER SCHAFFHAUSEN AG Sites and App, and we may use third party analytics and other service providers to evaluate and provide us and/or third parties with information about the use of the MOSER SCHAFFHAUSEN AG Sites and App. See more information in our Cookie Notice.

Except for addressing shipping orders to countries outside these territories and the transfer is necessary for the performance of your contract with us, we try to only transfer personal data to providers in Switzerland, the European Union, and the United Kingdom.

That being said, some of our providers are also located in the United States or have entities in the United States besides their offices and/or entities in the European Union. It is therefore important to note that your personal data may be transferred to this territory.
These providers have implemented various safeguards when transferring personal data to the United States.

In particular, we use Salesforce, Inc. when sending our Newsletter. Salesforce is part of the Data Privacy Framework Program – see here.

We also use Google Analytics and other tools proposed in its suite, as well as the Facebook pixel, which may lead to data transfers to the United States. For more information on GA and how to disable it, please see our Cookie Notice.

We require third parties, who may be based outside the country from which you have accessed the Sites and App, to comply with all relevant data protection laws. In addition, third parties are only allowed access to your personal data and use it on our behalf in relation to the specific tasks assigned to them, based on our instructions.

In any case where cross-border transfer is done, we request from our partners that an adequate protection is guaranteed for personal data to be transferred outside of Switzerland and the European Economic Area and Switzerland.

We might propose social plugins, in which case we may collect and process information relating to your account on social media platforms. The third-party platform’s use of information collected from you (or as authorized by you) is governed by its own privacy policy and your settings on the service.

How do we store, secure and retain data? 

We take all reasonable technical and organisational measures to protect the personal data we hold against loss, unauthorised access or disclosure and against other misuse. Your personal data will not be sold or disclosed to any other third parties except as provided in the Privacy Notice.

When the personal data that we collect is no longer required for the given purpose, or for legal requirements, we destroy or delete it in a secure manner.

How you may access your personal data and seek its correction

You have the following rights in relation to your personal data:

  • You have the right to be informed about how your personal data are processed and access to your personal data at any time by contacting us at marketing@h-moser.com
  • You have the right to rectify your personal data or to have your personal data erased under certain conditions;
  • You have the right to restrict the processing of your personal data under certain conditions and, when based on legitimate interest, you have the right to object to the processing;
  • When based on consent, you have the right to withdraw your consent at any time;
  • You have the right to data portability, that is, to receive the personal data in a structured, commonly used format. and to transmit those data to another controller without hindrance from us.

You can also limit the use of tracking technologies, such as cookies, by configuring your browser to warn you before accepting them, or you can simply configure it to refuse them.

If you feel that we are not respecting your rights or our obligations, you can lodge a complaint directly with your data supervisory authority at any time.
